The North Carolina Department of the Secretary of State, Securities Division's mission is to protect North Carolina investors. Consistent with that purpose, the Securities Division seeks to ensure a competitive securities market in North Carolina and increase investor confidence in the securities industry through education outreach, compliance and enforcement actions.

The position requires an experienced attorney to render legal advice and counsel on highly complex and novel issues to the agency. The major functions of this position involve rulemaking and providing advice on emerging issues in the areas of digital investment assets, athlete agents, business identity fraud, and intellectual property fraud. This position may also conduct and manage investigations through litigation in the enforcement of the North Carolina Securities Act (N.C.G.S.

Chapter 78A), the North Carolina Investment Advisers Act, including the Uniform Athlete Agents Act (N.C.G.S. Chapter 78C), the North Carolina Commodities Act (N.C.G.S. Chapter 78D) and other statutes under the authority of the Secretary of State.

This position may require occasional in-state and out-of-state travel for training, seminars or conferences. This position may be eligible for an alternate worksite arrangement in accordance with the Secretary of State's Teleworking Policy, but must permanently reside within 50 miles from the Securities Division office in Raleigh, North Carolina. KNOWLEDGE, SKILLS AND ABILITIES/COMPETENCIES: In order to be qualified, you must document on the application that you possess all of the following: Skill in reviewing and readopting administrative rules pursuant to the North Carolina Administrative Procedures Act (APA) and assisting with the rule-making process.

Skill in conducting research and drafting memorandum, briefs, motions, legislation or rules in clear and precise language. Ability to utilize investigative techniques and practices in the areas of financial/securities fraud or regulatory compliance. Ability to interpret and apply federal and state securities, investment adviser, commodities, athlete agent laws and their related administrative regulations.

Ability to prioritize and ensure compliance with timekeeping obligations. Extensive experience timely responding to executive and senior leadership in a clear and concise manner. MANAGEMENT PREFERENCES: Knowledge or experience with reorganization of financial firms under Chapter 11 bankruptcy laws.

NC APA Rulemaking experience. Experience rendering advice to a law enforcement organization Strong negotiation and project management skills A writing sample may be required. MINIMUM QUALIFICATIONS: Some state job postings say you can qualify by an equivalent combination of education and experience.
